You may be provided access to customer tools offered by third parties as part of the Services, which we do not monitor and over which we have no control or input.

Ondarela is powered by Shopify, which enables us to provide the Services. However, any sale or purchase made through our store is made directly with Ondarela. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales transaction between you and Ondarela, including injury, damage or loss resulting from the purchase of products and services. To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising out of or related to your purchase and transaction with Ondarela.

The following sections continue to apply after termination where relevant: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy and any other provisions that by their nature should survive termination.

WE DO NOT WARRANT THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONDARELA, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless Ondarela, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from losses, damages, liabilities or third-party claims, including reasonable legal fees, arising from your breach of these Terms of Service or documents incorporated by reference, your violation of applicable law or a third party’s rights, or your misuse of the Services.
We will notify you of any indemnifiable claim where reasonably practicable. We may control the defense and settlement of such a claim, but we will not settle a claim that imposes non-monetary obligations on you without your consent, which will not be unreasonably withheld. You agree to cooperate in the defense of indemnifiable claims, including by providing relevant documents.
